The Regulations on Energy Conservation of Public Institutions was passed at the 18th executive meeting of the State Council on July 23, 2008. It is hereby promulgated and will be implemented as of October 1, 2008.

Article 1 These Regulations are formulated in accordance with the Energy Conservation Law of the People's Republic of China in order to promote the energy conservation of public institutions, improve the energy efficiency of public institutions, and give play to the role of public institutions in energy conservation in the whole society.

Article 2 The term "public institutions" as used in these Regulations refers to state organs, institutions and organizations that use financial funds in whole or in part.

Article 3 Public institutions shall strengthen energy use management and adopt technically feasible and economically reasonable measures to reduce energy consumption, reduce and stop energy waste, and effectively and rationally use energy.

Article 4 The department in charge of energy conservation work of the State Council shall be in charge of the supervision and administration of energy conservation in public institutions throughout the country. Under the guidance of the department under the State Council's management of energy conservation, the agencies of the administrative affairs of the State Council are responsible for promoting, guiding, coordinating and supervising the energy conservation work of public institutions throughout the country.

Under the guidance of the department responsible for the management of energy conservation at the same level, the State Council and the local government departments at or above the county level shall be responsible for the energy conservation supervision and management of public institutions at the same level.

The competent departments at all levels of education, science and technology, culture, health, sports, etc., under the guidance of the agencies at the same level of management, carry out energy conservation work for public institutions within the system at the same level.

Article 5 The State Council and the institutions of the local people's governments at or above the county level shall, in conjunction with the relevant departments at the same level, conduct publicity, education and training on public institutions and popularize energy-saving scientific knowledge.

Article 6 The person in charge of a public institution shall be fully responsible for the energy conservation work of the unit.

The energy conservation work of public institutions implements the target responsibility system and the evaluation and evaluation system. The completion of energy conservation goals should be taken as the content of the assessment and evaluation of the responsible persons of public institutions.

Article 7 Public institutions shall establish and improve the rules and regulations for energy conservation management of their own units, carry out energy-saving publicity and education and post training, enhance staff awareness of energy conservation, foster energy-saving habits, and improve energy-saving management.

Article 8 The energy conservation work of public institutions shall be subject to social supervision. Any unit or individual has the right to report the waste of energy by public institutions, and relevant departments should investigate and handle the report in a timely manner.

Article 9 Units and individuals that have made outstanding achievements in the energy conservation work of public institutions shall be commended and rewarded in accordance with state regulations.

Article 10 The State Council and the institutions of the local people's governments at or above the county level shall, in conjunction with the relevant departments at the same level, formulate energy conservation plans for public institutions at the same level according to the medium- and long-term special plans for energy conservation of the people's governments at the same level.

The county-level public institution energy conservation plan shall include the energy conservation content of the public institutions in the township (town) under its jurisdiction.

Article 11 The energy conservation plan of a public institution shall include the guiding ideology and principles, the current status and problems of energy use, energy conservation goals and targets, key energy conservation links, implementation subjects, and safeguard measures.

Article 12 The State Council and the agencies of the local people's governments at or above the county level shall refer to the energy conservation targets and targets determined by the public institution's energy conservation plan to be decomposed into public institutions at the same level.

Article 13 Public institutions shall, in conjunction with the energy use characteristics of their own units and the energy use situation of the previous year, formulate annual energy conservation goals and implementation plans, and adopt energy conservation management or energy conservation transformation measures in a targeted manner to ensure the completion of energy conservation goals.

The public agency shall file the annual energy conservation goals and implementation plans with the agencies of the administrative organs of the people's governments at the same level.

Article 14 Public institutions shall implement an energy consumption measurement system, separate energy use types and energy use systems, implement energy consumption households, classification, and sub-item measurement, and conduct real-time monitoring of energy consumption status to timely discover and correct energy waste. .

Article 15 A public institution shall appoint a special person to be responsible for energy consumption statistics, truthfully record the raw data of energy consumption measurement, and establish a statistical account.

The public institution shall submit a report on the energy consumption of the previous year to the agency of the administrative department of the people's government at the same level before March 31 of each year.

Article 16 The State Council and the institutions of the local people's governments at or above the county level shall, in accordance with the administrative authority, formulate energy consumption quotas according to the comprehensive level and characteristics of energy consumption of public institutions in different industries and systems. The financial department sets energy consumption expenditure standards based on energy consumption quotas.

Article 17 Public institutions shall use energy within the scope of energy consumption quotas to strengthen the management of energy consumption expenditures; if energy consumption exceeds the energy consumption quota, it shall make an explanation to the agencies of the administrative organs of the people's governments at the same level.

Article 18: Public institutions shall, in accordance with the provisions of the State regarding compulsory procurement or preferential procurement, purchase products and equipment listed in the government procurement catalogue of energy-saving products and equipment and the government procurement catalogue of environmental labeling products, and may not purchase energy-using products that have been eliminated by the state. ,equipment.

Article 19 The government procurement supervision and administration department of the State Council and the provincial people's government shall, in conjunction with the relevant departments at the same level, improve the government procurement catalogue of energy-saving products and equipment, and prioritize the inclusion of products and equipment that have obtained energy-saving product certification certificates in the government procurement list.

The State Council and the provincial people's government shall include the products and equipment in the government procurement catalogue of energy-saving products and equipment into the government centralized procurement catalogue.

Article 20 The construction and renovation of new buildings and existing buildings of public institutions shall strictly implement the provisions and standards of the State concerning the design, construction, commissioning and completion acceptance of buildings, and the State Council and the competent construction departments of local people's governments at or above the county level shall implement the state. The supervision and inspection should be strengthened in the case of relevant regulations and standards.

The departments of the State Council and the local people's governments at or above the county level responsible for approving or approving fixed asset investment projects shall strictly control the construction scale and standards of public institution construction projects, make overall plans for energy conservation investments and benefits, and conduct energy conservation assessment and review of construction projects; Projects that fail to pass energy conservation assessment and review may not be approved or approved for construction.

Article 21 The State Council and the agencies of the local people's governments at or above the county level shall work with the relevant departments to formulate and implement the existing building energy conservation renovation plans for public institutions at the same level.

Article 22 Public institutions shall conduct energy audits in accordance with the regulations, conduct technical and economic evaluations on the operation and energy use of energy-using systems and equipment of the unit, and adopt measures to improve energy efficiency according to the audit results. The specific measures shall be formulated by the department in charge of energy conservation work of the State Council in conjunction with the relevant departments of the State Council.

Article 23 The contents of the energy audit include:

(1) Checking the completion acceptance data of buildings and the energy consumption system and equipment ledger data, and checking the implementation of energy-saving design standards;

(2) Checking the energy consumption measurement records and financial bills of electricity, gas, coal, oil, municipal heat, etc., and assessing the total energy consumption, per capita energy consumption and energy consumption per unit of building area of ​​the classification and sub-item;

(3) Examining the operation status of energy-using systems and equipment, and reviewing the implementation of the energy-saving management system;

(4) Examining the implementation of the previous energy audit for the rational use of energy;

(5) Finding energy-using links or parts with potential for energy conservation and proposing reasonable use of energy;

(6) Reviewing the annual energy conservation plan, the implementation of the energy consumption quota, and verifying that the public agency exceeds the energy consumption quota for the use of energy;

(7) Review the operation of energy measurement instruments and check the authenticity and accuracy of energy consumption statistics.

Article 24 Public institutions shall establish and improve the energy-saving operation management system and energy-use system operation rules of the unit, strengthen the operation adjustment, maintenance, inspection and inspection of energy-using systems and equipment, and implement low-cost, no-cost energy-saving measures.

Article 25 Public institutions shall set up energy management positions and implement an energy management post responsibility system. The operating positions of key energy-using systems and equipment should be equipped with professional and technical personnel.

Article 26 Public institutions may adopt contract energy management methods and entrust energy-saving service agencies to conduct energy-saving diagnosis, design, financing, transformation and operation management.

Article 27: When a public institution chooses a property service enterprise, it shall consider its energy conservation management capability. When a public institution enters into a property service contract with a property service company, it shall specify the objectives and requirements for energy conservation management.

Article 28 In implementing energy-saving renovations, public institutions shall conduct energy audits and investment income analysis, clarify energy-saving indicators, and adopt energy-saving retrofits to measure and comprehensively evaluate energy-saving indicators.

Article 29 Public institutions shall reduce the standby energy consumption of air-conditioning, computers, photocopiers and other electrical equipment, and shut down the electrical equipment in time.

Article 30 Public institutions shall strictly implement the state regulations on air-conditioning indoor temperature control, make full use of natural ventilation, and improve the operation and management of air-conditioning.

Article 31 The elevator system of public institutions shall implement intelligent control, reasonably set the number and time of elevator opening, and strengthen operation adjustment and maintenance.

Article 32 Public office buildings shall make full use of natural lighting, use high-efficiency energy-saving lighting fixtures, optimize lighting system design, improve circuit control methods, promote the application of intelligent control devices, and strictly control the external floodlighting of buildings and external decorative lighting. .

Article 33 Public institutions shall implement key monitoring of energy use in network equipment rooms, canteens, water-opening rooms, boiler rooms and other parts, and take effective measures to reduce energy consumption.

Article 34 The official vehicles of public institutions shall be equipped in accordance with the standards. The vehicles with low energy consumption, low pollution and clean energy shall be preferred, and the vehicle scrapping system shall be strictly implemented.

Public institutions shall use official vehicles in accordance with their prescribed purposes, formulate energy-saving driving regulations, and implement bicycle energy accounting systems.

Public institutions should actively promote the socialization of official car services and encourage staff to use public transport and non-motorized transport.
Chapter V Supervision and Protection

Article 35 The State Council and the institutions of the local people's governments at or above the county level shall, in conjunction with the relevant departments, strengthen the supervision and inspection of the energy conservation of public institutions at the same level. The contents of supervision and inspection include:

(1) The formulation and implementation of annual energy conservation goals and implementation plans;

(2) Measurement, monitoring and statistics of energy consumption;

(3) Implementation of the quota of energy consumption;

(4) The establishment of rules and regulations for energy conservation management;

(5) The establishment of energy management posts and the implementation of the responsibility system for energy management posts;

(6) Energy-saving operation of energy-using systems and equipment;

(7) Conducting energy audits;

(8) The equipment and use of official vehicles.

For public institutions whose energy conservation rules and regulations are not perfect and the energy consumption exceeds the energy consumption quota, the key supervision and inspection shall be carried out.

Article 36 Public institutions shall cooperate with energy conservation supervision and inspection, truthfully explain the relevant information, provide relevant materials and data, and may not refuse or hinder.

Article 37 If a public agency has one of the following acts, the agency that handles the affairs of the administrative organ of the people's government at the same level shall, in conjunction with the relevant department, order it to make corrections within a time limit; if it fails to make corrections within the time limit, it shall be notified, and the responsible person of the public agency shall be legally responsible by law. Give punishment:

(1) failing to formulate annual energy conservation goals and implementation plans, or failing to record annual energy conservation goals and implementation plans in accordance with regulations;

(2) The energy consumption measurement system has not been implemented, or the energy consumption type and energy use system have not been divided into energy consumption households, classification, and sub-item measurement, and the energy consumption status is monitored in real time;

(3) failing to designate a person to be responsible for energy consumption statistics, or failing to record the raw data of energy consumption measurement and establishing a statistical account;

(4) failing to submit the report on the state of energy consumption of the previous year as required;

(5) Exceeding the energy consumption of energy consumption in a fixed amount, and failing to explain to the agency of the administrative organ of the people's government at the same level;

(6) No energy management positions have been established, or professional technicians have not been equipped in key energy-using systems and equipment operation positions;

(7) failing to conduct an energy audit in accordance with the regulations, or failing to adopt measures to improve energy efficiency based on the audit results;

(8) Refusing or obstructing energy conservation supervision and inspection.

Article 38: Public institutions do not implement the government procurement catalogue of energy-saving products and equipment, and fail to purchase products or equipment listed in the government procurement catalogue of energy-saving products and equipment in accordance with the state's regulations on compulsory procurement or preferential procurement, or the procurement of countries to eliminate them. If the products or equipment are used, the government procurement supervision and administration department shall give a warning and may impose a fine concurrently; the directly responsible person in charge and other directly responsible personnel shall be given disciplinary action according to law and shall be notified.

Article 39 If the department responsible for approving or approving a fixed asset investment project approves or approves a public institution construction project that has not passed the energy conservation assessment and review, the directly responsible person in charge and other directly responsible personnel shall be given disciplinary action according to law.

If a public institution starts construction projects that fail to pass energy conservation assessment and review, the relevant authorities shall order the rectification within a time limit; the directly responsible supervisors and other directly responsible personnel shall be given disciplinary sanctions according to law.

Article 40 If a public institution violates the provisions of the over-standard, super-prepares the purchase of official vehicles or refuses to scrap the vehicles with high energy consumption and high pollution, the directly responsible personnel and other directly responsible personnel shall be given disciplinary action according to law, and the people at the same level shall be punished according to law. In accordance with the relevant regulations, the agencies of the government's administrative organs shall take measures such as taking back, auctioning, and ordering the vehicles.

Article 41 If a public institution violates the provisions and can use energy to waste energy, the organization that handles the affairs of the administrative organ of the people's government at the same level shall issue a power conservation rectification opinion with the relevant department, and the public institution shall implement it in a timely manner.

Article 42 If a staff member of an agency that handles the affairs of a public agency abuses power, neglects duties, or engages in malpractices for fraud in the supervision and administration of public institutions, and constitutes a crime, it shall be investigated for criminal responsibility according to law; if it does not constitute a crime, it shall be punished according to law.
Chapter VI Supplementary Provisions

Article 43 These Regulations shall come into force on October 1, 2008.
